  1. Alaska: Maximum $10,000 fine and a year jail sentence
  2. Utah: Maximum $750 fine and a 90-day jail sentence
  3. Maine: Maximum $500 fine
  4. Wisconsin: Maximum $400 fine and 4 points added to your license
  5. New York: Maximum $235 fine and 3 points added to your license

The top five states with the most lenient penalties (for the first offense) are:

  1. Pennsylvania: Maximum $50 fine
  2. Delaware: Maximum $50 fine
  3. Indiana: Maximum $35.50 fine
  4. Iowa: Maximum $30 fine
  5. Virginia: Maximum $20 fine
